VI. Personal Data Subject Obligations (Customer / User)

10. Order of Products

The visitor / user of the site, provided that he / she has legal capacity to do so as defined in the Civil Code, i.e. has reached the age of eighteen and is not subject to legal assistance in entering a sales or distant sales contract, may order the products available for sale at dev.hicare.shop, in accordance with the terms and conditions of the ordering process. The company may request orders be placed by a supervisor or guardian in cases of legally incapable persons.

To place a valid order, once the products have been selected and added to their shopping cart the visitor / user must: (a) complete the information required to conclude the contract of sale (shipping address, payment method, etc., pricing option etc.) (b) Fully accept the terms of the contract of sale (product, price, shipping, etc.) and these terms of use, which form an integral part of the contract. The payment method is chosen by the visitor / user and includes the option of charging a credit or debit card (selected via the ordering system), using PayPal's online payment system or making a deposit. In detail, payment can be made in one of the following ways:

13. Shipping - Product Delivery - Shipping Charge

Where we send:

We provide shipping throughout Greece, Cyprus and 29 European Countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Lithuania, Luxembourg, The Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and England.

For shipments in Greece

The products are delivered at your location by the Speedex courier company with an estimated delivery time of the next business day for shipments to Athens and Crete, and of 2+ business days for shipments to the rest of Greece. Also for Remote and Inaccessible Areas the estimated delivery time can be 2 - 4 business days.

Please note that dev.hicare.shop is not responsible for complying with estimated delivery times, as they depend on the local courier office’s service.

 

Charges

For purchases of a total value of under €30 and up to a weight of 3kg the shipping cost is € 2.90, with an additional charge of 2 euro per kilo for each additional kilo.

For purchases totaling over €30 and up to a weight of 3kg shipping is free of charge, with an additional charge of 2 euro per kilo for each additional kilo.

The Cash on Delivery payment method carries an additional flat fee of € 3.50 regardless of the value of the order.

Order completion times

At Hicare we strive daily to serve your needs promptly and it is our priority to deliver your order promptly and correctly through our courier company. Your order is therefore processed immediately, but in cases where any of the products are not available in our store, we will immediately inform you of any waiting times - there may be a waiting time for some products that could reach 3 - 10 working days.

For shipments to Cyprus and European countries

Shipments to Cyprus and European countries are made within 2 - 12 business days. Their cost depends on the weight of the shipment and is added at the completion of your order so you can control the total cost. In this case the bank deposit payment option is not available, as payment can only be made via credit / debit cards or PayPal. Products are shipped once payment is confirmed.

NOTE: No orders are shipped or delivered during weekends.

When registering and processing your order, you may receive automated messages (email / SMS / Viber) informing you of the progress of your order - you are advised to keep them for the duration of our transaction.

14. Consumer Rights

1. Right of Withdrawal - Return Policy

The consumer has the right to withdraw from a sale within fourteen (14) calendar days, unless a longer deadline has been agreed on, returning the product in its original state, without incurring any costs other than shipping, return costs and any charges or commissions incurred from the payment method selected. This period shall begin upon receipt of the products. In order to exercise the right of withdrawal, the consumer is obliged to fill in and submit the withdrawal form electronically at dev.hicare.shop and have retained the invoice or receipt.

When the right of withdrawal is exercised, the consumer shall also be obliged to dispatch the product immediately in its sealed packaging and in the condition it was received in for a refund, and the supplier shall, subject to all the required procedures and regulations described in the terms of use, be obliged to refund the amounts to the consumer within thirty (30) calendar days of receiving the product at dev.hicare.shop.

Full refund  of the price is done with the same method as the payment was made, except in case of COD. If the price has been debited to the consumer's credit card, exercising the right to withdraw also entails the termination of the relevant three-way contract between the consumer, supplier and the bank, without payment of compensation.

If the price is paid in cash and the consumer exercises the right to withdraw then the price will be refunded to the consumer's bank account, with exact bank account details provided to the company in writing. In this case, the consumer shall be solely responsible for the accuracy and validity of the data and information provided. In the case of cash on delivery, the refund does not include shipping costs and courier charges for cash on delivery.

2. Right of replacement

The consumer has the right to request the replacement of a product if the delivered item is defective, damaged, faulty or does not correspond to the product ordered. In this case, it is necessary to immediately contact the Company via the telephone numbers or email located in the "Contact" section of the Website in order to initiate the replacement or refund process. In the event of receipt of a defective, damaged or faulty product, it is also necessary to send photographic material showing the defect or damage to the product as well as the package received from the carrier. It is also a prerequisite for the product to be in the condition it was received in, unused, and for the consumer to have the sales document. In any event, the maximum time-limit for a refund may not exceed fifteen (15) calendar days from the date of receipt. Shipment of the new product will take place within the same time period as the original shipment. In the event of a refund, the refund terms set out above apply.

In each case of the return of a product, the customer is obliged to also all the documents that accompanied the product deliver intact and in excellent condition (e.g. SAD, sales receipt, marketing material or any other promotional material, etc.).

dev.hicare.shop bears no responsibility or liability whatsoever beyond the order value if it has been prepaid for any damage, damages or other issues arising such as failure to provide support services or delays in sending an order for any reason.

3. Submitting Complaints

In any case where the consumer is not satisfied with the order fulfillment or for any other reason regarding dev.hicare.shop they have the right to register a complaint with the company, within fifteen (15) days of appearance of the problem, by completing the online contact form or by e-mail.

The consumer's complaint will be dealt with promptly and the response will be sent by the company within ten (10) days of its receipt to the consumer’s email address. In considering the complaint, the company reserves the right to contact the consumer to clarify the circumstances that caused the alleged problem. In this case, the consumer should facilitate by providing the relevant information to resolve the issue.

In any case concerning the operation of the online store, the consumer, subject to these terms of use, is obliged to follow the complaint procedure before any legal action is taken.

We would be happy to assist you with any problems or questions you may have, so please feel free to contact us by email or phone. 15. Reward Points

To qualify for point redemption you must already be a member and log in to your account or register as a new member at dev.hicare.shop by creating a new account. Customer / user participation in the loyalty and point program, which is provided free of charge, does not entail any charge.

There are many ways to earn points - the key is with your purchases.

With each purchase you earn points from your cart, for example if you make a purchase worth €30.00 you will get 60 points.

But there are other ways to earn points:

1. By reviewing a product you purchased you will be rewarded with 2 points. Reviewing a purchased item helps other users with their purchases (it will take a short period of time for us to approve your review and award you your points. You may also leave up to 6 reviews a day).

2. Using social media - by sharing products on Instagram and Facebook, you will earn 2 points, you can share up to 2 products per day.

These methods of earning points can be done on a daily basis as opposed to the following two methods which can only be used once:

1. Subscribing to the Newsletter instantly awards 200 points.

2. Registering as a New Customer awards 200 points.

When you have collected a minimum of 500 points, that is, €5 worth of purchases, you can redeem them by deducting the corresponding amount from your order.

Non-compliance of the user / visitor of this site with these Terms with regard to reward points such as any theft / unlawful acquisition of points, etc., entitles the business to take all necessary measures and / or legal actions to remedy such unlawful or illegal conduct, and in particular, the company will immediately delete an account and / or cancel any points earned illegally.
